Lazich Fires Back at Judge's Decision

A Dane County judge today struck down the controversial budget repair bill.

A Dane County judge today struck down the controversial budget repair bill that eliminated most collective bargaining for most public employees.

Dane County Circuit Judge Maryann Sumi released a 33-page decision Thursday nullifying Act 10, which prompted thousands of protestors to crowd the state Capitol for weeks.

Supporters of the law have fired back with opposition to her decision, including State Senator Mary Lazich who represents Greendale.

"If Judge Sumi wants to create law, or write law or change law, she should become a legislator," said Lazich in statement. "She should not legislate from the bench."

Lazich says was surprised to learn that Sumi made the decision today today, as she was under the impression that it was already with the Supreme Court awaiting a decision.

But the decision, posted on The Wheeler Report, will not end the litigation. The state Supreme Court has been asked to consider the case, and state legislators are preparing to re-insert the collective bargaining changes in the state's 2011-13 budget.

Greendale State Rep. Jeff Stone was not able to be reached for comment. A staff member at his office said the Stone has not been fully informed behind the reasons Sumi struck down the law.
