Update: Off-Duty Cop Accidently Fires Gun in Southridge Mall
The officer was reaching into his pocket to buy a pretzel when the gun went off.
An off-duty Milwaukee Police officer's gun was accidently discharged inside Southridge Mall while he was shopping on Wednesday afternoon. No one was injured and nothing was damaged.
The officer accidently discharged his firearm into the floor while reaching into his pocket to retrieve money in front of Auntie Anne's Soft Pretzels on the second level of the mall.
The officer was standing near the register when the gun went off and the bullet hit the floor.
The gun never fell to the floor, said Greendale Police Chief Bob Malasuk.
Greendale Police did not cite him.
Milwaukee Police Ed Chief Flynn told Fox6Now, "He was not trying to take any action. He didn't engage in any tomfoolery. He was examined and found fit for duty by two separate police agencies. It's an accident and the investigation will continue."
Southridge Mall manager Mary Mokwa said that Southridge has always has a ban on weapons, even before the conceal carry law went into effect.
Correction: The gun never fell to the floor as previously stated.

So police are trusted to carry but the rest of us cannot in this banned area? Why would a police officer not use a holster? Why would he keep anything else in the same pocket as his gun?

He did not use a holster, stuffed the gun in his pocket with other items, and pulled the trigger because he violated all the rules and he was told them.

I highly doubt it discharged upon hitting the floor. Pretty much every modern firearm these days is "drop proof". PS. Incoming liberal posts about how now this will be a common occurrence cuz if it happens to a cop imagine how many CCW holders who are drunk will be dropping their guns in church, etc.

1) It is stupid to have other things in your pocket with your firearm. 2) It is stupid to not use a holster. 3) Firearms don't discharge when dropped (federal law requires them to pass the drop test). 4) Why have the firearm in a pocket when an inner waist band (IWB) holster is far, far superior? Especially since a IWB holsters usually have retention. 5) Police seem to have more issues with abiding by the law than the rest of us (http://www.jsonline.com/watchdog/watchdogreports/at-least-93-milwaukee-police-officers-have-been-disciplined-for-violating-law-132268408.html).

The guns do not accidentally go off. The trigger had to be pulled. This event was the result of the user. In the last 32 years I taught firearms I never saw an unintended discharge that was caused by the gun, all were the operators fault. Most any firearm built in the last several decades will not fire without help from a person even if you drop the thing down a flight of stairs. TV shows guns firing after falling on the floor which is a total lie, I've watched students draw and throw the gun down range and all that happened was the gun got dirty.

It's nice to know that Southridge is OK with concealed carry now, & the Greendale cops won't charge people breaking the posted mall rules (trespassing) as well as acting in an unsafe manner, endangering public safety, acting in a manner which could reasonably be forseen to produce public alarm (disorderly conduct), etc.
Or will Greendale PD cave to public opinion & follow the law?
Charge him w/ trespassing, endangering public safety, etc., just as any other citizen would be who's not employed by a LEA.
Heck, turn the officer over to Wisconsin Carry members for retraining.
At least we know how to use a holster.

A police officer does not come under the concealed carry law that just went into effect. There is a specific state law that has been on the books for longer than anybody in here has been alive that allows an officer to carry.

If Southridge had a law that said NO WEAPONS ALLOWED even before the new law was passed, why isn't this "offduty" cop getting some sort of fine or being named?? If this was just an ordinary person, I think their name would've been published by now.
And a cop should have his weapon secured where this can't happen!
